Mediation, Arbitration and dispute resolution
In business or your personal life if a problem escalates to a dispute, it needs to be resolved quickly, before the profitability and / or productivity of the business or relationship starts to be affected. Because of the delay and expense which may occur if matters go to Court, or if there is a need to preserve business or personal relationships, the better option may be to utilise alternative dispute resolution techniques. There are a variety of such techniques, but the most commonly used technique at the present time is mediation.
Mediation is a process in which an independent third person assists the disputing parties to find a mutually acceptable solution. The mediator helps the parties to resolve the dispute themselves, arriving at a settlement agreement that suits both. This informal process has been found to be speedy and cost effective in most instances.
O’Connor Harris can advise clients on whether mediation will be suitable for their dispute and assist clients with preparation of position statements (where appropriate) or other written presentations. O’Connor Harris would also represent you at the mediation itself. |
